These Terms of Service govern your use of websites operated by House of Sociatea, including the Sociatea and The Merry Wolf websites, and purchases made through those websites.

Throughout these Terms, “House of Sociatea”, “we”, “us” and “our” refer to  trading as House of Sociatea, including its brands Sociatea and The Merry Wolf.

By accessing or using our websites, or purchasing products from us, you agree to these Terms of Service.

Please read them carefully before using our websites or placing an order.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or any other law that cannot lawfully be excluded.

We take reasonable care to ensure product descriptions, photographs, dimensions, ingredients, packaging information, pricing and other information displayed on our websites are accurate.

However, minor variations may occur.

Colours can appear differently depending on your device or screen settings, and natural products such as tea, herbs and botanicals may vary slightly between batches in appearance, aroma or flavour.

Packaging may occasionally be updated or vary from imagery displayed on the website, provided the product supplied remains materially consistent with its description.

If we become aware of a material error in a product listing, we will take reasonable steps to correct it.

Nothing in this section limits your rights under the Australian Consumer Law.

4. Tea and Taste

Tea is a natural product and individual taste preferences vary.

Descriptions of flavour, aroma, body, strength and drinking style are intended to help you choose a product but are necessarily subjective.

We do not guarantee that a particular tea will suit your personal taste.

A dislike of the taste, aroma, style or strength of a tea does not, by itself, mean that the product is faulty or entitle you to a refund or exchange.

This does not affect your rights where a product is faulty, unsafe, contaminated, incorrectly described or otherwise fails to meet a consumer guarantee.

5. Product Availability

All products are subject to availability.

Adding an item to your cart does not reserve that item.

From time to time, an item may become unavailable after you place an order because of stock discrepancies, damage, supply issues or another circumstance outside our reasonable expectations.

If we are unable to supply an item you have ordered, we will contact you and provide an appropriate remedy, which may include:

  • refunding the unavailable item;

  • offering an appropriate alternative with your agreement; or

  • cancelling and refunding the affected part of the order.

We will not substitute a materially different product without your agreement.

6. Orders

When you submit an order through one of our websites, you are offering to purchase the products listed in your order at the displayed price, including any applicable delivery charges.

You are responsible for checking your order details before submitting your order, including:

  • products and quantities;

  • delivery address;

  • contact information; and

  • payment details.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted the order for fulfilment.

An order is accepted when we process it for fulfilment or dispatch, subject to any rights we may have to correct genuine errors, respond to suspected fraud or deal with unavailable products.

7. Cancelling an Order

If you contact us before your order has been processed for fulfilment, we may be able to cancel or amend it.

We cannot guarantee that an order can be changed or cancelled once it has been submitted.

Once an order has been processed or dispatched, our Refund & Returns Policy applies.

House of Sociatea may cancel an order where reasonably necessary, including where:

  • a product is unavailable;

  • there has been an obvious pricing or listing error;

  • payment cannot be authorised;

  • we reasonably suspect fraud or unauthorised payment;

  • an order breaches these Terms; or

  • we are legally unable to fulfil the order.

Where we cancel an order after receiving payment and you have not received the relevant goods, we will refund the amount paid for the cancelled item or order.

8. Pricing

All prices displayed on our Australian websites are in Australian dollars (AUD).

Unless otherwise stated, retail prices include GST where GST applies.

Delivery charges, where applicable, will be displayed during checkout before you complete your purchase.

We may change our prices from time to time.

A price change will not ordinarily affect an order we have already accepted.

9. Pricing and Listing Errors

We take reasonable care when displaying prices and product information, but errors may occasionally occur.

If a product has been listed at an obviously incorrect price because of a genuine error, we may contact you before fulfilment to explain the error.

You may then choose to purchase the product at the correct price or cancel the affected item.

If the affected order is cancelled, any amount already paid for that item will be refunded.

We will not use this provision to retrospectively increase the price of an order simply because we later decide to change our pricing.

10. Payment

You must pay for your order using one of the payment methods available at checkout.

Payment must be successfully authorised before an order can be fulfilled.

Payment processing may be provided by third-party payment providers. Your use of those services may also be subject to the provider's applicable terms.

We do not guarantee that every payment method will always be available.

11. Promotions and Discount Codes

From time to time, House of Sociatea, Sociatea or The Merry Wolf may offer promotional prices, offers or discount codes.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;

  • only one promotional code may be used per order;

  • promotional codes must be used within their stated validity period;

  • offers apply only to eligible products;

  • promotional codes cannot ordinarily be applied retrospectively to completed orders; and

  • promotions are subject to any additional conditions disclosed with the offer.

We may refuse or cancel the use of a promotional code where it has been used fraudulently, unlawfully or contrary to the conditions of the promotion.

Specific promotions may have separate terms and conditions.

12. Shipping and Delivery

We currently deliver within Australia.

Orders are packed and dispatched by House of Sociatea from Angaston, South Australia.

Shipping charges and available delivery methods will be displayed at checkout where applicable.

Any delivery timeframe provided is an estimate unless we expressly state otherwise.

Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, weather events, public holidays or disruptions to transport networks.

Please refer to our Shipping Policy for further details regarding dispatch, delivery, lost parcels and other shipping matters.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law in relation to goods that are not supplied within the required or agreed timeframe.

13. Delivery Address

You are responsible for providing a complete and accurate delivery address when placing your order.

Please contact us as soon as possible if you notice an error.

We will make reasonable efforts to amend an address where an order has not yet been dispatched, but we cannot guarantee that changes can be made after an order has entered fulfilment.

Where an order is returned to us because an incorrect or incomplete address was supplied by the customer, we may contact you regarding redelivery and any reasonable additional delivery costs, subject to applicable law.

14. Returns, Refunds and Consumer Guarantees

Our Refund & Returns Policy forms part of these Terms and should be read together with them.

House of Sociatea does not offer returns, refunds or exchanges merely because you change your mind or decide that you do not like the taste of a product.

However, our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may have rights to a repair, replacement, refund or other remedy where goods:

  • are not of acceptable quality;

  • are not fit for an applicable disclosed purpose;

  • do not match their description or sample; or

  • otherwise fail to meet an applicable consumer guarantee.

Nothing in these Terms or our Refund & Returns Policy is intended to exclude or restrict those rights.

15. Website Accounts

Where our websites allow you to create an account, you are responsible for maintaining the confidentiality of your login information.

You should provide accurate and current account information and notify us if you believe your account has been accessed without authorisation.

We may suspend or restrict an account where we reasonably believe this is necessary because of:

  • suspected fraud;

  • security concerns;

  • unlawful activity; or

  • serious or repeated breaches of these Terms.

16. Intellectual Property

Unless otherwise stated, the content of our websites is owned by or licensed to House of Sociatea.

This may include:

  • brand names and trade marks;

  • logos;

  • product names;

  • packaging and label designs;

  • photographs;

  • illustrations;

  • graphics and artwork;

  • website design;

  • written copy;

  • recipes;

  • editorial content;

  • guides; and

  • other original material.

The Sociatea and The Merry Wolf brands, their creative assets and associated content may not be reproduced, republished, distributed, modified or commercially exploited without permission where doing so would infringe our intellectual property rights.

You may view and use our website for normal personal shopping and informational purposes.

Nothing in these Terms transfers ownership of our intellectual property to you.

17. Reviews and Customer Content

If we provide functionality allowing customers to submit reviews, photographs, comments or other material, you must not submit content that is unlawful, defamatory, misleading, discriminatory, abusive, infringing or fraudulent.

You must have the right to submit any material you provide.

Where you voluntarily submit a review or other content for publication, you grant us permission to display and reproduce that material for the purpose for which it was submitted, including displaying a product review on our website.

We will not claim ownership of your underlying intellectual property merely because you submit content to us.

Those third parties may operate under their own terms and privacy practices.

Nothing in this section excludes liability that cannot legally be excluded.

Any editorial, educational or lifestyle information published through Sociatea, The Merry Wolf or House of Sociatea is provided for general information only.

Tea-related content concerning rituals, wellbeing, ingredients or lifestyle should not be understood as personalised medical or health advice.

You should seek appropriate professional advice where your circumstances require it.

Nothing on our websites is intended to diagnose, treat, cure or prevent a medical condition unless expressly stated and lawfully permitted.

21. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, House of Sociatea will not be responsible for indirect or consequential loss that was not reasonably foreseeable as a result of our breach.

Any limitation in these Terms applies only to the extent permitted by applicable law.

By using our websites, you acknowledge that certain information may be collected and processed as reasonably necessary to operate the website, process orders, provide customer service and otherwise conduct our business, subject to applicable privacy laws and our Privacy Policy.

When you place an order, we may send you transactional communications reasonably necessary to manage that order, including:

  • order confirmations;

  • dispatch and tracking notifications;

Changes will apply prospectively and will not be used to retrospectively remove rights that arose under an order already accepted by us.

The remaining provisions will continue to apply.

26. Governing Law

These Terms are governed by the laws applicable in South Australia, Australia.

You and House of Sociatea submit to the jurisdiction of the courts of South Australia and any courts entitled to hear appeals from them.

Nothing in this section limits any rights you may have to bring a claim or exercise a right in another jurisdiction where applicable consumer law permits you to do so.
